# Terms of Service

## Acceptance of terms

These [Terms of Service](https://etho.net/terms) (“Terms”) govern your access to and use of the website located at etho.net and any related public-facing services, content, blog posts, downloadable tools and guides, and forms operated by Etho, Inc. (collectively, the “Site”).

By accessing or using the Site, you agree to be bound by these Terms and our [Privacy Policy](https://etho.net/privacy). If you do not agree, you must not use the Site.

If you access or use the Site on behalf of an organization, you represent that you are authorized to bind that organization to these Terms, and “you” refers to both you individually and that organization.

## About Etho

Etho, Inc. (“Etho,” “we,” “us,” or “our”) is a Delaware corporation headquartered in Goodyear, Arizona. Etho is the parent company of Olympus, our AI-powered marketing platform, which is offered at [getolympus.ai](https://www.getolympus.ai).

These Terms cover your use of the Site only. Olympus, its paid plans, and any work produced for paying clients are governed by the Olympus terms at [getolympus.ai](https://www.getolympus.ai) and by any signed Master Services and License Agreement (“MSLA”), order form, or statement of work between Etho and the client.

## Use of the website

Subject to your compliance with these Terms, Etho grants you a limited, non-exclusive, non-transferable, revocable license to access and view the Site for your personal or internal business informational purposes.

### Eligibility

You must be at least 18 years old to use the Site. By using the Site, you represent and warrant that you meet this requirement and that your use does not violate any applicable law or regulation.

### No account required

The public Site does not require an account. Certain interactions, such as subscribing to our blog, downloading a tool or guide, or contacting us, collect information voluntarily provided by you and are governed by our [Privacy Policy](https://etho.net/privacy).

## Downloads

Tools, templates, calculators, guides, and other materials you download from the Site (“Downloads”) are licensed to you for use in your own business. You may adapt them for internal use, but you may not resell, sublicense, or republish them, in whole or in part, without our written permission.

Downloads are provided “as is.” Results from calculators and templates are estimates based on the inputs you provide, not predictions or professional advice. You are responsible for how you use them.

## Olympus and paid services

The Site contains information, demos, and marketing materials about Olympus and Etho’s other products.

Nothing on the Site constitutes an offer to provide the Olympus platform or any paid service, and no contractual relationship is formed by your visit alone.

Access to and use of the Olympus platform requires a separately executed MSLA, which contains the binding terms governing licensing, fees, deliverables, support, data handling, and AI output for paying clients. In the event of any conflict between these Terms and a signed MSLA with Etho, the MSLA controls with respect to the subject matter of that agreement.

Pricing, tier descriptions, capacity limits, and feature lists shown on the Site are illustrative and subject to change without notice. Final commercial terms are set forth in your executed agreement.

## Intellectual property

### Etho’s content

All content on the Site, including text, graphics, logos, icons, images, audio, video, software, source code, design, layout, the Etho name and logo, the Olympus name and logo, and all underlying technology, is owned by Etho or its licensors and is protected by United States and international copyright, trademark, trade secret, and other intellectual property laws.

### Limited permission

You may view, download, and print content from the Site solely for your personal, non-commercial reference, provided you do not remove or alter any copyright, trademark, or other proprietary notices. Any other use, including reproduction, modification, distribution, public performance, framing, scraping, training of machine-learning models, or commercial exploitation, requires Etho’s prior written permission.

### Trademarks

“Etho,” “Olympus,” “Innovate Impossible,” and associated logos and designs are trademarks of Etho, Inc. You may not use these trademarks without our prior written consent.

## User submissions

When you submit information through the Site, such as a blog subscription, a download request, a contact form, or feedback, you represent that the information is accurate and that you have the right to provide it.

### Feedback license

If you provide Etho with any suggestions, ideas, enhancement requests, recommendations, or other feedback regarding the Site, Olympus, or any of Etho’s products or services (“Feedback”), you grant Etho a perpetual, irrevocable, worldwide, royalty-free license to use, modify, and incorporate such Feedback into our products and services without any obligation to you.

## AI-generated content

The Site may display content, including blog posts, demos, examples, marketing copy, images, or videos, that was generated, drafted, or edited with the assistance of artificial intelligence, including outputs from Etho’s Olympus platform.

AI-generated outputs may contain inaccuracies, biases, or errors.

Etho does not warrant the accuracy, completeness, or suitability of any AI-generated content for any particular purpose. You are solely responsible for independently verifying any information on the Site before relying on it for business, medical, financial, legal, or other decisions.

Nothing on the Site constitutes legal, medical, financial, tax, regulatory, or compliance advice.

## Acceptable use

You agree not to use the Site to:


Violate any applicable law or regulation, including the CAN-SPAM Act, TCPA, FTC advertising rules, industry-specific advertising regulations, or advertising-platform policies (Meta, Google, etc.)


Send spam, unsolicited communications, or harassing messages


Submit content that is illegal, fraudulent, deceptive, defamatory, obscene, or harmful


Impersonate any person or misrepresent your affiliation with any person or entity


Attempt to gain unauthorized access to the Site, our servers, our networks, or any account


Interfere with, disrupt, or place an unreasonable load on the Site’s infrastructure, including by means of automated scraping, crawling, or denial-of-service techniques


Reverse engineer, decompile, or attempt to derive the source code of any software made available through the Site


Use the Site, or any content obtained from it, to train artificial-intelligence or machine-learning models without Etho’s prior written consent


Remove, alter, or obscure any copyright, trademark, or other proprietary notices

We may suspend or terminate your access to the Site at any time, with or without notice, for any conduct we believe violates these Terms.

## Third-party links and services

The Site may contain links to third-party websites, products, or services that are not owned or controlled by Etho. We do not endorse and are not responsible for the content, privacy practices, or availability of any third-party sites or services.

Your interactions with any third party, including advertisers, payment processors, or service providers reached through the Site, are solely between you and that third party.

## Disclaimers

THE SITE AND ALL CONTENT ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS, IMPLIED, STATUTORY, OR OTHERWISE.

To the fullest extent permitted by law, Etho disclaims all warranties, including implied warranties of merchantability, fitness for a particular purpose, title, and non-infringement.

Etho does not warrant that the Site will be uninterrupted, secure, error-free, or free of viruses or other harmful components, or that any defects will be corrected.

Any reliance you place on information available through the Site, including AI-generated outputs, is strictly at your own risk.

Additional disclaimers about results, testimonials, educational content, and downloadable tools appear on our Disclaimers page and form part of these Terms.

## Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, IN NO EVENT WILL ETHO, ITS AFFILIATES, OR THEIR RESPECTIVE OFFICERS, DIRECTORS, EMPLOYEES, OR AGENTS BE LIABLE TO YOU FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR EXEMPLARY DAMAGES, INCLUDING LOST PROFITS, LOST REVENUE, LOST DATA, OR BUSINESS INTERRUPTION, ARISING OUT OF OR RELATED TO YOUR USE OF THE SITE, EVEN IF ETHO HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

ETHO’S TOTAL CUMULATIVE LIABILITY ARISING OUT OF OR RELATING TO THESE TERMS OR YOUR USE OF THE SITE WILL NOT EXCEED ONE HUNDRED U.S. DOLLARS ($100).

Where you have a separate paid agreement with Etho (such as an MSLA), the liability cap in that agreement governs disputes related to those paid services.

Some jurisdictions do not allow the exclusion or limitation of certain damages. In those jurisdictions, our liability is limited to the maximum extent permitted by law.

## Indemnification

You agree to indemnify, defend, and hold harmless Etho and its officers, directors, employees, and agents from and against any third-party claims, liabilities, losses, damages, costs, and expenses (including reasonable attorneys’ fees) arising out of or relating to:


Your use of or access to the Site


Your violation of these Terms


Your violation of any law, regulation, or third-party right


Any content or information you submit through the Site

## Privacy

Your use of the Site is also governed by our [Privacy Policy](https://etho.net/privacy), which describes how we collect, use, and protect personal information. By using the Site, you consent to the data practices described in the [Privacy Policy](https://etho.net/privacy).

## Termination

We may suspend or terminate your access to the Site at any time, with or without notice, for any reason, including any conduct we believe violates these Terms or is harmful to Etho, its users, or others.

You may stop using the Site at any time. Provisions that by their nature should survive termination, including Intellectual Property, AI-Generated Content, Disclaimers, Limitation of Liability, Indemnification, Governing Law and Disputes, and Miscellaneous, will survive termination of these Terms.

## Governing law and disputes

These Terms are governed by and construed in accordance with the laws of the State of Arizona, without regard to its conflict-of-laws principles.

Any dispute, claim, or controversy arising out of or relating to these Terms or your use of the Site will be resolved by binding arbitration in Maricopa County, Arizona, or, at the parties’ option, in the state or federal courts located in Maricopa County, Arizona. Each party bears its own attorneys’ fees and costs unless the arbitrator or court orders otherwise.

YOU AND ETHO AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS OR REPRESENTATIVE PROCEEDING.

## Changes to these terms

We may update these Terms from time to time. When we do, we will revise the “Effective Date” at the top of this page. Material changes will be communicated through the Site or by other reasonable means.

Your continued use of the Site after changes become effective constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Site.

## Miscellaneous

Entire agreement

These Terms, together with the [Privacy Policy](https://etho.net/privacy) and any signed agreement between you and Etho, constitute the entire agreement between you and Etho regarding your use of the Site, and supersede any prior or contemporaneous communications regarding the same subject matter.

Severability

If any provision of these Terms is held to be invalid or unenforceable, the remaining provisions will remain in full force and effect.

Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of that right or provision.

Assignment

You may not assign or transfer these Terms without our prior written consent. We may assign these Terms to any successor in interest or affiliate without notice.

No third-party beneficiaries

These Terms are for the exclusive benefit of you and Etho. No other person or entity has any right to enforce any provision.

Force majeure

Etho will not be liable for any failure or delay in performance caused by events beyond our reasonable control, including acts of God, natural disasters, war, terrorism, civil disturbance, governmental actions, labor disputes, third-party platform outages, or power or internet failures.
